AT A MEETING OF THE BANK (HOUSE PURCHASE) SUB-COMMITTEE HELD AT THE BANK HEAD OFFICE ON MONDAY, THE 9TH JANUARY, 1933

 

PRESENT:

           Councillor Cooper, in the Chair,

1198.  An apology for non-attendance was received from Alderman Sir Percival Bower.

 

1199. RESOLVED:- That Minutes Nos. 972/1159, 1170, 1190, and 1191 be continued.

 

1200.  On Minutes Nos. 972/1159 (39, Waverill Road, Handsworth), Minute No. 1170 (9, Pineapple Road, King's Heath), and Minute No. 1191 (171, Monica Road, Small Heath), the Sub-Committee were informed that payments were being made and the Minutes were continued.

 

On Minute No. 1190 (25, Capcroft Road, Billesley), the General Manager reported that Mr. Wilde had been instructed to obtain estimates for putting the property into a proper state of repair, and it was -

 

1201.  RESOLVED:- That the Chairman be authorised to accept the most suitable estimate for carrying out the work.

 

On Minute No. 1193 (253, Brook Lane, Billesley), the General Manager reported that the Trustee in Bankruptcy raised no objection to the Bank obtaining possession of this property with a view to sale, and it was accordingly -

 

1202.  RESOLVED:- That the General Committee be recommended to instruct the Town Clerk to obtain possession of the property with a view to sale.

 

The House Purchase (General) Advance Book was submitted giving particulars on page 37 of advances in 17 cases since the last meeting of the Sub-Committee.

 

1203.  RESOLVED:- That the advances made in the cases above-mentioned be confirmed.

 

The House Purchase (Supplemental) Advance Book was submitted giving particulars on page 13 of advances granted in 3 cases since the last meeting of the Sub-Committee and showing the extent to which such advances were guaranteed by the Finance Committee under the Birmingham Corporation Act, 1919.

 

1204.  RESOLVED:- That the above-mentioned advances be approved and confirmed so far as the Bank is concerned.

 

The General Manager submitted a list of special cases, on consideration of which it was -

 

1205.  RESOLVED:- That in the following cases the General Committee be recommended to instruct the Town Clerk to take proceedings to recover the arrears and if necessary to obtain possession of the properties:-

 

              5, Blounts Road, Stockland Green.

            52, Ashbrook Road, Stirchley.

 

1206. RESOLVED:- That in the following cases the Mortgagors be allowed to make payment of interest only for a period of three months:-

 

           320, Shirley Road, Hall Green.

            265, Haunch Lane, King's Heath.

 

1207. RESOLVED:- That the Mortgagor of No. 55, Bromford Crescent, Birches Green, be permitted to continue weekly payments of 15/- for a period of three months, at the end of which time the position be reviewed.

 

1208.  RESOLVED:- That the Mortgagor of No. 5, Brentford Road, King's Heath, be permitted to make a weekly payment of £1 until the arrears are discharged.

 

1209. The Sub-Committee considered the circumstances in the case of No. 216, Tyburn Road, Erdington, which the Public Works Committee had taken back owing to the condition of the property. The Mortgagor had applied for an advance of £410 on a house situated in Dare Road, Erdington, but the Sub-Committee decided that the amount of advance to be authorised be £360, representing 80% of the valuation.

 

1210. The General Manager submitted the following list of cases of Mortgagors in arrears with payments, giving particulars of the circumstances in each case:-

In December last the Bank Committee authorised proceedings in this case, the arrears then amounting to £9. 13. -. A payment of £7 was received on the January 1933.

The mortgagor notified the Bank that owing to a big reduction in staff at the General Electric Company on the 1st November he lost his employment. He states that the payment of £7 represents practically a year's dividend from a Sick Club, that his total weekly income is £1. 8. 6d which will cease in February next, and that he has no suggestion to offer.

The question of arrears has been dealt with by the Town Clerk on no less than six occasions and this is a case in which it is not desirable to allow the arrears to increase.

Owing to loss of employment, the mortgagor paid interest for four months and has since continued to make monthly payments.

The mortgagor has taken a position as insurance agent with the Royal London Mutual Society and states that while the value of his book is increasing, he finds it impossible to maintain the monthly payments of principal and interest. If at all possible he desires to retain the property and states that if he is given time he will no doubt be able to pull round. With regard to his rates, the mortgagor states that he has been given time in which to pay; that the amount owing under the Second Mortgage is very small and no pressure is being brought to bear in this direction. He therefore desires to be accorded permission to pay interest only under his mortgage for a few months.

The mortgagor states that he has called at the Bank without waiting for an official letter and that he has no debts apart from the liabilities attaching to the property.

Whilst this mortgagor has been in arrears on one or two occasions, it has been entirely due to his being suspended from work. The mortgagor has called at the Bank and states that his health has failed and that he has now been ordered to a sanatorium for some months. He submits a letter asking whether in these circumstances the position with regard to his payments may be eased to enable his wife to carry on and inquires whether the Bank would accept payment of interest only.

The Bank Committee authorised proceedings in December last and having received from the Town Clerk a Notice to Quit the mortgagor is again maintaining weekly payments of 12/6d. He has called at the Estates Department, interviewed the Assistant General Manager, and states that he is endeavouring to sell the property through Messrs. Wilde & Glover for the sum of £300.

In a letter dated 24th February 1932 received by the Bank it was stated that the Estates Committee had decided to grant the mortgagor a house to rent as soon as he had sold the above property.

In view of the resolution of the Bank Committee, instructions are desired as to whether the Town Clerk is to commence legal proceedings for possession.

The mortgagor not making regular weekly payments, and in view of a long explanatory letter dated 14th December 1932, the Bank Committee decided to adjourn further consideration of the case for one month provided a regular weekly payment of 15/- was maintained.

The mortgagor stated that he was compelled to reduce his weekly payment from £1 to 15/- having regard to the fact that he had other bills to meet. He also stated that his wife is still having medical attention and that he is prepared to continue a weekly payment of 15/-.
